Food Safety Team (including health & safety and infectious diseases)
Who do we hold personal information about ?
- People who operate food premises (such as restaurants, take-aways, sandwich shops etc) in the Borough
- People who contract certain infectious diseases which are required to be notified to the Council
- People who are involved in certain breaches of health and safety legislation which are required to be notified to the Council
- People we have to take enforcement action against in connection with food premises, infectious diseases or breaches of health and safety requirements
What types of personal information do we hold ?
We will collect and use the following types of personal information :
Food businesses:
- The proprietor’s contact details (such as name, address, telephone number, email address)
- The registration form for the food business
- Inspection records for the food business
This is usually information that you will supply to us or which we will have compiled during our dealings with the food business
Health & safety matters:
- Contact details for those involved (such as name, address, telephone number, email address)
- Inspection and / or investigation records
This is usually information that you will supply to us or which we will have compiled during our investigation
Infectious diseases:
- Contact details for those affected (such as name, address, telephone number, email address)
- Dates of birth of those affected
- Contact details for the GP of for those affected (such as name, address, telephone number, email address)
- Questionnaires completed by those affected
This is usually information that you or your medical advisor will supply to us or which we will have compiled during our investigation
Enforcement action:
- Contact details for witnesses and complainants (such as name, address, telephone number, email address)
- Witness statements and details of the complaint
- Written notes or recordings of interviews with the person or people under investigation
- CCTV footage if available and relevant
This is information which we will have compiled during our investigation or which will have been supplied to us by the complainant and other witnesses
What types of special categories of personal information do we hold ?
We may collect and use personal information about your race or ethnicity where you speak a language other than English. This is usually information that you and / or your medical advisor will supply to us.
We may also collect and use the following types of personal information about you in the case of enforcement matters:
- Medical reports from a hospital or GP
- Details of previous criminal convictions in respect of those under investigation
We may also collect and use the following types of personal information about you in the case of infectious disease matters:
- Hospital test results for those affected
- Information about the health and medical condition of those affected
- Information about the sexual life of those affected where relevant to the infectious disease
This is usually information that you and / or your medical advisor will supply to us.
What do we use personal information for ?
- To process applications to register food businesses
- To inspect food businesses
- To fulfil our statutory duties in respect of infectious diseases which are required to be notified to the Council
- To fulfil our statutory duties in respect of breaches of health and safety legislation which are required to be notified to the Council
- To take enforcement action using our statutory powers
What is the legal basis for the use of personal information ?
We will process your personal information (including special categories of personal information) in accordance with our obligations under the Data Protection Act 2018. In particular we will use your personal information:
- With your consent; and / or
- To protect your vital interests or those of another person; and / or
- Where this is necessary to perform a task in the public interest or in the exercise of official authority vested in the Council
We will use your special categories of personal information:
- with your consent; and / or
- where this is necessary to protect your vital interests or those of another individual where you are physically incapable of giving consent; and / or
- where this is necessary for reasons of public interest in the area of public health; and / or
- the use of the data is necessary for carrying out our obligations under social protection law; and / or
- the use of the data is necessary for the establishment and pursue legal claims
Who might we share your personal information with ?
Sometimes we will share your personal information with other agencies in order to perform a task in the public interest or in the exercise of official authority vested in us. For example, we may share your personal information:
- with Public Health England in respect of infectious diseases
- (in respect of RIDDOR notifications in health and safety matters we may share the information with any of the following if relevant to the incident in question) with Lancashire County Council (if necessary for safeguarding purposes), the Health & Safety Executive, the Fire Service and the Care Quality Commission
- Food business registration forms may be shared with Lancashire County Council Trading Standards Team where we are working jointly in the exercise of our statutory food safety functions
