Who do we hold personal information about ?
- People who apply for building regulation approval and / or their agents, architects and contractor(s)
- People who complain to us about dangerous structures or other matters within the remit of the Building Control service
- People we have to take enforcement action against in respect of dangerous structures or a breach of the law relating to building control
What types of personal information do we hold ?
We will collect and use the following types of personal information :
- Your contact details (such as name, address, telephone number, email address)
- Contact details for your agent, architect and contractor(s) if you have them (such as name, address, telephone number, email address)
- Your bank details in order to take payment of the Building Control fee, but your details are entered directly into a database maintained by the Council’s Finance Section and are not retained, or accessible, by Building Control staff
This is usually information that you and / or your agent(s) will supply to us
What types of special categories of personal information do we hold ?
We will collect and use the following types of personal information about you:
- Information about your health (if you are applying for an exemption from fees on the basis of disability)
This is usually information that you and / or your agent(s) will supply to us
What do we use personal information for ?
- To process applications for statutory building control approval
- To take enforcement action using our statutory powers in respect of dangerous structures
- To respond to enquiries made as part of a local land charges search
What is the legal basis for the use of personal information ?
We will process your personal information (including special categories of personal information) in accordance with our obligations under the Data Protection Act 2018. In particular we will use your personal information:
- With your consent; and / or
- To protect your vital interests or those of another person (for example in respect of dangerous structures); and / or
- Where this is necessary to perform a task in the public interest or in the exercise of official authority vested in the Council
We will use your special categories of personal information with your consent.
Who might we share your personal information with ?
Sometimes we will share your personal information with our contractors and agents and other agencies in order to perform a task in the public interest or in the exercise of official authority vested in us. For example, we may share your personal information:
- With other departments of the Council and other statutory bodies that we are required to consult before we reach a decision in respect of your application for building regulation approval; and
- The Council’s street naming and numbering officer in connection with the Council’s statutory street naming and numbering functions; and
- The Council’s Housing & Regeneration Section in connection with any application you may make for a disabled facilities grant; and
- The Council’s Housing & Regeneration Section in connection with any enforcement activity they may take or be considering in exercise of their statutory powers (for example in respect of empty properties)
- The Council’s Environmental Health Section in connection with any enforcement activity they may take or be considering in exercise of their statutory powers
